These Terms of Service govern your access to and use of the S.I.T. Strings website and your purchase of products from us. Please read them carefully. By visiting our site or placing an order, you agree to be bound by these Terms.

In these Terms, "we", "us" and "our" refer to Stay In Tune String Company, doing business as S.I.T. Strings, 2493 Romig Rd, Akron, OH 44320, United States. "You" refers to the visitor or customer.

Our Return and Refund Policy, Shipping Policy and Privacy Policy are incorporated into these Terms by reference and form part of your agreement with us.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are under that age, you may use this site only with the involvement of a parent or guardian who agrees to these Terms on your behalf.

You may not use our products or site for any unlawful purpose, or in violation of any law in your jurisdiction, including export control and intellectual property laws.

2. Your Account

If you create an account, you are responsible for keeping your password confidential and for all activity that occurs under your account. Please tell us promptly at sales@sitstrings.com if you believe your account has been used without your permission.

We may refuse service, close accounts, or cancel orders at our discretion, including where we reasonably suspect fraud, unauthorized resale, or a breach of these Terms.

3. Products, Pricing and Availability

All prices are shown in United States dollars and are subject to change without notice. We may change, limit, or discontinue any product at any time, and we may limit the quantity of any product we sell to any person, household, or order.

We work to display our products accurately, but we cannot guarantee that your screen will reproduce colors and finishes exactly. Product photography is illustrative; packaging and appearance may vary.

We make reasonable efforts to keep product descriptions, gauges, specifications and pricing accurate. If a product is listed at an incorrect price or with incorrect information, we reserve the right to cancel or refuse any order placed for that product, whether or not the order has been confirmed and your payment method charged. If we cancel an order after you have been charged, we will issue a full refund.

4. Orders and Acceptance

Your order is an offer to buy. Our confirmation email acknowledges that we received your order; it does not constitute acceptance. A contract is formed when we ship your order.

We reserve the right to refuse or cancel any order for any lawful reason, including limited availability, errors in pricing or product information, or suspected fraudulent activity.

You agree to provide current, complete and accurate purchase and account information for all purchases made through our store, and to promptly update your email address, payment details and shipping address so we can complete your order and contact you as needed.

5. Payment

Payment is taken at the time you place your order. By providing a payment method, you represent that you are authorized to use it and that the information you supply is accurate. Payment card details are processed by our payment provider; we do not store full card numbers.

Applicable sales tax is calculated and added at checkout where required.

6. Shipping, Title and Risk of Loss

Shipping costs, processing times and international terms are set out in our Shipping Policy.

Title and risk of loss pass to you when we hand your order to the carrier. Delivery estimates provided by us or by a carrier are estimates only and are not guaranteed. If a shipment is lost or damaged in transit, we will work with you and the carrier as described in our Shipping Policy.

For international orders, you are the importer of record and are responsible for any customs duties, import taxes and brokerage fees charged by your country, and for ensuring the products may lawfully be imported to your destination.

7. Returns and Limited Warranty

Returns and warranty claims are governed by our Return and Refund Policy. In summary, unused and unopened products may be returned within 30 days of purchase, and our limited warranty covers defects in materials and workmanship for 30 days from the date of purchase.

The limited warranty described in that policy is the only warranty we provide. Strings are a consumable product with a finite playing life, and breakage, corrosion and tonal change through normal use are expected characteristics of the product rather than defects.

8. Disclaimer of Warranties

Except for the limited warranty expressly set out in our Return and Refund Policy, our products and this site are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that this site will be uninterrupted, timely, secure or error-free, or that the results obtained from using our products or site will be accurate or reliable.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, some of the exclusions above may not apply to you.

9. Limitation of Liability

To the fullest extent permitted by law, Stay In Tune String Company, its officers, employees, affiliates, suppliers and dealers will not be liable for any indirect, incidental, punitive, special or consequential damages arising from your use of this site or of our products. This includes, without limitation, damage to instruments, hardware, amplifiers or other equipment, lost profits, lost income, or costs of substitute goods.

Where liability cannot be excluded, our total liability to you for any claim will not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow the limitation of liability for consequential or incidental damages. Where that is the case, our liability is limited to the maximum extent permitted by law.

10. Correct Installation

Strings must be installed correctly and to the appropriate tension for your instrument. Improper installation, over-tensioning, kinking, or fitting a gauge unsuitable for your instrument can cause string breakage and can damage the instrument. Installation is your responsibility, and damage arising from it is not covered by our limited warranty. If you are unsure, we recommend having your strings fitted by a qualified technician.

11. Intellectual Property

All content on this site — including the S.I.T. and S.I.T. Strings names and logos, product names, packaging design, text, product photography, artist photography and biographies, video, and site design — is owned by us or our licensors and is protected by copyright, trademark and other intellectual property laws.

You may not reproduce, distribute, modify, publicly display or create derivative works from any part of this site without our prior written permission. Artist names, images and likenesses appear with permission and may not be reused.

12. Submissions and Feedback

If you send us ideas, suggestions, proposals, artist applications, dealer enquiries, reviews or other materials, whether at our request or unprompted, you agree that we may use, edit, copy, publish and distribute them in any medium without restriction and without obligation to compensate you or to keep them confidential.

You are responsible for any material you submit, including its accuracy and legality. You agree not to submit material that is unlawful, defamatory, obscene, infringing, or that contains malicious code. We may, but are not obliged to, monitor, edit or remove submissions.

13. Dealers and Distributors

Products purchased through an authorized dealer or distributor are subject to that seller's own terms of sale. Wholesale, dealer and distributor relationships are governed by separate agreements and are not covered by these Terms.

14. Third-Party Links

This site may contain links to third-party websites that we do not control. We are not responsible for the content, accuracy, products or practices of those sites, and their inclusion does not imply our endorsement. Any dealings with third parties are solely between you and them.

15. Prohibited Uses

In addition to other restrictions in these Terms, you may not use this site or its content to: engage in any unlawful purpose; solicit others to perform unlawful acts; infringe our or any third party's intellectual property rights; harass, abuse, defame or discriminate; submit false or misleading information; upload viruses or malicious code; collect or track the personal information of others; scrape, spider or crawl the site; or interfere with the security features of the site. We may terminate your access for breach of any of these restrictions.

16. Indemnification

You agree to indemnify and hold harmless Stay In Tune String Company and its officers, employees, affiliates and suppliers from any claim or demand, including reasonable attorneys' fees, made by a third party arising out of your breach of these Terms or your violation of any law or the rights of a third party.

17. Governing Law and Venue

These Terms and any separate agreements by which we provide you products are governed by the laws of the State of Ohio, United States, without regard to its conflict of law provisions. You agree that the state and federal courts located in Summit County, Ohio have exclusive jurisdiction over any dispute arising from these Terms, and you consent to personal jurisdiction there.

18. Severability and Entire Agreement

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will remain in full force. Our failure to exercise or enforce any right under these Terms does not waive that right.

These Terms, together with the policies referenced above and any operating rules posted on this site, constitute the entire agreement between you and us regarding your use of the site, and supersede any prior agreements or communications.

19. Changes to These Terms

We may update these Terms at any time by posting an updated version on this page. It is your responsibility to check this page periodically. Your continued use of the site after changes are posted constitutes acceptance of those changes.
